Terms of Service — mynd

These Terms govern your access to and use of the mynd website (https://mynd.im), app (https://app.mynd.im), and related services (the “Service”). By using the Service, you agree to these Terms.
1) Accounts and eligibility
You must be at least 13 years old (or the age of digital consent in your jurisdiction) and able to enter a binding contract. You are responsible for your account credentials and for all activity under your account.
2) Google sign-in and connected accounts
You may connect your Google account to enable features that interact with Google Calendar and Gmail. When you do, you authorize mynd to access Google data only within the scopes shown on Google’s OAuth consent screen. You can disconnect at any time in your Google Account or within mynd; disconnecting stops further access.
If you enable features that require restricted Gmail scopes (e.g., reading message content), you acknowledge that Google imposes additional requirements on us and on how that data can be used and transferred (the Limited Use rules).
2.1) Email drafts and mailbox changes
By enabling email features, you authorize mynd to:
- Create and manage Gmail drafts you request (using
https://www.googleapis.com/auth/gmail.compose). - Apply mailbox changes you request—such as marking read/unread, archiving, or adding/removing labels—(using
https://www.googleapis.com/auth/gmail.modify).
We request the minimum necessary permissions and, where possible, obtain them incrementally in context so you understand why access is needed. We do not request https://mail.google.com/ and we do not use IMAP/SMTP.
3) Your content
You retain ownership of your content. You grant mynd a limited, worldwide, non-exclusive license to host, process, and display your content solely to operate the Service and provide the features you select. You are responsible for ensuring you have rights to the content you connect or upload.
4) Acceptable use
- Interfere with or disrupt the Service, bypass access controls, or probe without authorization.
- Misuse Google APIs, exceed granted scopes, or attempt to access data you are not authorized to access.
- Use the Service to send spam or unlawful communications, or to infringe others’ rights.
We may suspend or terminate access for violations.
5) Software, AI-assisted features, and beta
Some features use automated systems (including AI) to assist with drafting, scheduling, or summarization. Outputs are provided “as is” and may contain errors; review before relying on them. Beta or experimental features may change, have limited support, or be withdrawn.
6) Third-party services and subprocessors
You may connect third-party services (e.g., Google). Their use is governed by those third parties’ terms and policies. We also use service providers to host and operate the Service (e.g., Vercel for hosting/deployments; Convex for backend/database and background jobs). We remain responsible for their performance as our processors.
7) Privacy
Our Privacy Policy describes how we handle personal data, including Google data accessed via OAuth, and forms part of these Terms.
8) Security; restricted scopes compliance
We implement technical and organizational measures to protect the Service. For features that use restricted Gmail scopes and store or transmit restricted data, Google may require us to undergo a Cloud Application Security Assessment (CASA) or similar verification; we will comply with such requirements as applicable.
We adhere to the Google API Services User Data Policy (including Limited Use) and provide accurate, prominent disclosures about who is requesting data, what data is requested, and why, consistent with Google’s requirements. 9) Fees
If we offer paid plans, pricing and billing terms will be presented in the Service. Fees are non-refundable except as required by law.
10) Disclaimers
THE SERVICE IS PROVIDED “AS IS.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11) Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL MYND BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US, IF ANY, FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) USD $100.
Some jurisdictions do not allow certain limitations; in those cases, the above limits apply to the fullest extent permitted.
12) Indemnification
You will indemnify and hold harmless mynd and its affiliates, officers, directors, employees, and agents from any claims, losses, and expenses (including reasonable attorneys’ fees) arising from your content, your use of the Service, or your violation of these Terms or applicable law.
13) Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access immediately if you violate these Terms, present a security risk, or where required by law. Upon termination, your license ends and we may delete your content in accordance with the Privacy Policy.
14) Changes
We may update these Terms from time to time. If changes are material, we will provide notice (e.g., by email or in-app). Continued use after the effective date constitutes acceptance.
15) Governing law; venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Courts located in Los Angeles County, California will have exclusive jurisdiction.
16) Export controls
You must comply with all applicable export control and sanctions laws in your use of the Service.
